Hurricane clause for Shaitan of Tortola for late summer charters
If a Named Storm, or expected to be a named storm, when reaching the location / expected location of the chartered vessel (defines as a windstorm given a name as a tropical storm or hurricane by the National Hurricane Center Miami, FL) threatens the location / expected location of the charted vessel within a period of 96 hours, as determined by the Captain in his sole discretion, the Captain shall have the option of terminating the charter if Charterers have boarded or refusing boarding if the charter has not yet commenced. The Captain's decision to terminate or refuse boarding shall be final. Upon such termination, the Captain shall immediately disembark the Charterers at the nearest safe port where further transportation or safe lodging is available. No refund of the charter fee will be made. Safe debarkation of the guest discharges all obligations of the parties to each other and no party shall be held liable to any other party for any loss, injury, damage or expenses incurred or resulting from such a Named Storm.
If a Named Storm, or expected to be named storm, is threatening to cross Lon. of 60 degrees W between Lat. 13 degrees N and 19 degrees N in the North Atlantic within 96 hours of the commencement of the charter, the Captain shall have the option to refuse to deliver the vessel to the port of embarkation of the charter.
No refund of deposits paid shall be made in this case.
Estimated tracks and positions of windstorms or hurricanes shall be the tracks and estimated positions published by the National Hurricane Center in Miami, FL, as well as the estimated wind forces, when reaching the area in question.
